Terms of Service

These Terms of Service ("Terms") govern your use of the Gutsy mobile application ("the app," "Gutsy," or "the Service") operated by Sudjeev Singh ("we," "us," or "our"). By downloading, installing, or using Gutsy, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Gutsy, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you do not agree with any part of these Terms, you must not use the app.

2. Description of Service

Gutsy is a personal health tracking application that allows users to log food, symptoms, stool health, medications, supplements, and water intake. The app provides AI-powered food analysis, FODMAP classification, wellness scoring, trigger detection, and personalized insights.

3. Important Health Disclaimer

Gutsy is not a medical device and does not provide medical advice, diagnosis, or treatment.

• The app is designed as a personal tracking and wellness tool to help you understand patterns in your digestive health.
• AI-generated insights, FODMAP classifications, wellness scores, trigger correlations, and chat responses are informational only and should not be relied upon as medical advice.
• Always consult a qualified healthcare provider, gastroenterologist, or registered dietitian before making changes to your diet, medication, or health routine based on information from Gutsy.
• Do not use Gutsy as a substitute for professional medical advice. If you are experiencing a medical emergency, contact emergency services immediately.
• FODMAP classifications and food analyses are AI-generated estimates and may not be 100% accurate. Always verify with a healthcare professional if you have severe allergies or intolerances.

4. Account Registration

• You may create an account using Sign in with Apple or email/password.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You agree to provide accurate and complete information when creating your account and health profile.
• You may delete your account at any time through the app's Settings.

5. Subscriptions & Payments

5.1 Free & Premium Tiers

Gutsy offers a free tier with basic features and a premium subscription that unlocks additional features including AI photo analysis, AI chat, trigger detection, weekly reports, FODMAP reintroduction guide, supplement tracking, and data export.

5.2 Subscription Terms

• Billing: Subscriptions are billed through your Apple ID account via the App Store. Pricing is displayed in the app at the time of purchase.
• Renewal: Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the end of the current period.
• Cancellation: You can cancel your subscription at any time through your Apple ID settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain premium access until then.
• Refunds: Refund requests are handled by Apple in accordance with their refund policy. We do not process refunds directly.

5.3 30-Day Satisfaction Guarantee

Gutsy offers a 30-day satisfaction guarantee on all premium subscriptions. If you have used Gutsy consistently and have not discovered at least one food trigger, we will support you in obtaining a refund through Apple's standard refund process. To be eligible:

• The request must be made within 30 days of the original subscription purchase date.
• The app must have been used as intended, with regular food, stool, and symptom logging during the 30-day period. "Regular" means logging at least 5 days per week on average.
• Contact us at support@thegutsyapp.com and we will guide you through Apple's refund process at reportaproblem.apple.com.

All subscription refunds are processed by Apple in accordance with their refund policy. Gutsy does not process refunds directly. This guarantee applies to the first subscription period only and does not apply to renewals.

5.4 Price Changes

We reserve the right to change subscription pricing. Any price changes will apply to new subscriptions and renewals after the change date. Existing subscribers will be notified by Apple before any price increase takes effect.

6. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse engineer, decompile, or disassemble the app.
• Attempt to gain unauthorized access to our servers, backend systems, or other users' data.
• Use the app to transmit harmful, abusive, or objectionable content through the AI chat feature.
• Misuse the AI features by submitting content that is illegal, harmful, or unrelated to health tracking.
• Share your account credentials with others or create multiple accounts to abuse free trials.
• Use automated tools, bots, or scrapers to access the app or its services.

7. AI-Generated Content

• Gutsy uses artificial intelligence (powered by OpenAI) to analyze food photos, classify FODMAP status, provide chat responses, and generate health insights.
• AI-generated content is provided on an "as-is" basis and may contain inaccuracies. We do not guarantee the accuracy, completeness, or reliability of any AI-generated analysis or recommendation.
• You should independently verify any AI-generated food classifications if you have severe allergies, intolerances, or medical conditions.
• We continuously work to improve AI accuracy but cannot guarantee error-free results.

8. Intellectual Property

• Gutsy, including its design, code, graphics, logos, and content, is the intellectual property of Sudjeev Singh and is protected by copyright and intellectual property laws.
• You retain ownership of all personal data and content you create within the app (logs, photos, notes).
• By using the app, you grant us a limited license to process your content solely for the purpose of providing the Service (e.g., sending photos to the AI for analysis).

9. Data & Privacy

Your use of Gutsy is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the app, you consent to our data practices as described in the Privacy Policy.

10. Third-Party Services

Gutsy integrates with third-party services including OpenAI, Firebase, Apple HealthKit, Apple StoreKit, Mixpanel, and Open Food Facts. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Gutsy is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the app will be uninterrupted, error-free, or free from harmful components.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app.
• Our total liability for any claim arising from the Service shall not exceed the amount you paid for the app in the 12 months preceding the claim.
• We are not liable for any health outcomes, dietary decisions, or medical consequences resulting from your use of Gutsy or reliance on its AI-generated content.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sudjeev Singh from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the app, violation of these Terms, or infringement of any third-party rights.

13. Termination

• You may stop using Gutsy at any time by deleting the app and, if applicable, cancelling your subscription and deleting your account.
• We reserve the right to suspend or terminate your access to the app if you violate these Terms or engage in abusive behavior.
• Upon termination, your right to use the app ceases immediately. Data stored on your device remains under your control.

14. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated through the app or by updating the "Effective date" above. Continued use of the app after changes constitutes acceptance of the updated Terms. If you disagree with any changes, you should stop using the app.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which the developer resides, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the use of Gutsy and supersede any prior agreements.
